The certificate is issued to the Client if the Client:
- Conscientiously and timely fulfills all requirements of the contract, including payment of all types of audits and fees, including accreditation fees.
- Constantly fulfills (responds to) all orders of certification standards and other applicable regulations and reports of the certification body.
- A license agreement has been concluded for the right to use the FSC® trademark (for FSC® certification).
- Signed declaration of association with FSC® (for FSC® certification).
- If the area of certification is subject to change, the Client informs the Certification Body about it and a decision of the certification body must be made on this matter.
To confirm the certificate and throughout its validity period, the client performs:
- All requirements of applicable regulatory documents of certification systems and certification body.
- All requirements of the certification body and certification systems regarding public and other statements, logos, certification marks and the use of trademarks when promoting their products.
- Not to interfere with the conduct of the certification body and/or certification systems and/or the accreditation body in order to confirm the Client’s compliance with all requirements of regulatory documents.
- To carry out the procedure for responding to and considering any complaints and appeals received by the Client, which affect the area of his certification or potentially affect it.
Information and information exchange
The client shall notify the certification body in writing immediately before the implementation or at least within 10 (Ten) calendar days of the following changes:
- changes in its management structure, in particular changes in senior management, personnel who have the right to make binding decisions affecting certification, as well as changes in the composition of technical personnel who are responsible for the processes included in the Client’s certification area;
- Updating the status of the Contractor, who is engaged by the Client to perform works included in the scope of certification, in particular, legal, commercial, organizational or change of organizational legal form and / or form of ownership;
- changes in products or methods of production / management of forestry, the size of managed territories, etc. regarding the applied chemicals, pesticides and other changes that may not comply with the regulatory documents of the certification systems;
- changes in the contact data of the Client and/or his responsible employees, as well as the location of production sites, forest plots, other similar changes;
- changes in the quality management system, which lead to changes in the certification area and / or lead to an increase in the risks of non-compliance with the conditions.
Use of FSC® trademarks
Use of FSC® trademarks, namely: the FSC® logo in the form of a tree, the name “Forest Stewardship Council® ” and the abbreviation “FSC®” must meet the requirements of FSC® (label size, registration mark, etc. .). Any use of the FSC® trademarks “on products” and for advertising purposes is possible subject to the prior written approval of the certification body.
The certification body has the right to immediately suspend or revoke the certificate in case the Client ceases to meet the requirements imposed on him by the certification scheme. The certification body will conduct control audits of the Client who received the certificate annually or more often than once a year in accordance with the certification report containing the Client’s specific obligations regarding such audits. If the implementation of the specified measures becomes impossible due to the fault of the Client, the validity of the certificate is subject to termination, which will be immediately entered by the Certification Authority in the database of certificates, and the Client will be notified of the reasons, terms of termination and conditions for renewing the certificate. If the Client does not fulfill the conditions necessary for the renewal of the certificate within the terms set by the Certification Body, the certificate is revoked, information about which is recorded by the Certification Body in the database issued FSC® certificates.
Suspension or cancellation of the certificate is also carried out in the following cases:
- If the Client does not pay for certification services or has not paid in full.
- If the Client directly or indirectly prevents the certification body from conducting the certificationsystem and/or audit accreditation body.
- If, according to the results of audits, 5 (five) or more Significant are identified in the Client’s activities inconsistencies with the requirements of the standards applicable in the assessment.
- If the Client refuses to pay the annual administrative fee for any reason.
In case of termination or revocation of the certificate, the Client must immediately:
- without additional notifications from the certification body, return the certificate to the certification body or destroy its original, as well as oblige to destroy any electronic and paper copies in its possession and provide the certification
- body with certificates of the specified actions;
- stop using any trademarks of certification systems and certification bodies;
- stop selling certified products, including pre-marked products;
- stop making statements that assume that the products released by the Client meet the requirements of the certification system;
- identify all applicable existing customers and notify such customers of termination or revocation in writing within three (3) business days of termination or revocation, and maintain a working record of such notices;
- to allow and not prevent the representatives of the certification body and certification system from conducting an inspection in order to obtain confirmation of the Client’s fulfillment of these obligations after the revocation and/or termination of the certificate;
- remove all uses of the name, initials, logos, certification marks or trademarks from its products, documents, advertising or marketing materials at its own expense.
